On May 22, 2007, the ACLU-NJ and ACLU-Immigrant Rights Project, along with other immigrant rightsâ•˙ attorneys, filed a habeas petition on behalf of Warren Joseph, a detainee who has been held for three years without a bond hearing. Mr. Joseph was a lawful permanent resident of the United States since 1987 and a decorated veteran of Gulf War I, but was convicted of a gun charge in 2001 for which he received probation and which arguably made him deportable. Given the extensive time the government held him pending deportation, the habeas petition focused on seeking his release from detention pending a decision on his status. During the first week of June 2007, Mr. Joseph was deemed eligible for both cancellation of removal and naturalization. After the government chose not to appeal this decision, it released him from detention, thus successfully resolving his habeas petition.
