In February 2005, the ACLU-NJ filed suit on behalf of condo-unit owners in the Galaxy Towers in Guttenberg who say they have been denied their right to criticize condo association officers, communicate with fellow residents and fairly compete in association board elections. The suit argues that condo owners who are not on the board are improperly barred from distributing materials under their neighbors' doors while incumbent board members do so regularly; that there is an unfair ban prohibiting condo owners from speaking at the board's televised meetings; that only letters favorable to the board are permitted in the condo newsletter; and that owners are denied equal access to the only meeting room large enough to hold a town hall style meeting. The complaint alleges violations of the state constitution as well as state and federal statutes.
