The ACLU-NJ filed an amicus brief in this appeal to the New Jersey Supreme Court on behalf of Beth Mason, who sued the city of Hoboken when it denied her access to various government records. The lower courts significantly limited the rights of citizens under the Open Public Records Act to appeal decisions by government agencies who deny access to documents. The ACLU-NJ argued against the lower courts' requirement that appeals take place within 45 days of the denial and against the imposition of a heightened standard in order for her to obtain attorneys' fees. The case currently is scheduled for oral argument.
