Andrew Policastro v. Theodora Kontogiannis, et al.

The ACLU-NJ filed an amicus brief and presented arguments before the court in this federal appeal on behalf of Tenafly high school teacher Andrew Policastro, who sued the school district for denying him the right to place contract-related information in colleagues' office mailboxes. Although the teachers' union regularly uses these mailboxes to disseminate information on contract negotiations, Principal Theodora Kontogiannis twice removed Policastro's memos from teachers' mailboxes, saying they distracted teachers from their classroom duties. The trial judge agreed. The case is pending before the 3rd U.S. Circuit Court of Appeals. Our appellate brief raises issues involving free speech, particularly the so-called "Heckler's Veto" and content-based discrimination.
