In January 2004, the ACLU-NJ, in cooperation with the state Office of the Public Defender, re-filed a case in New Jersey Superior Court, Mercer County, challenging the Sex Offender Internet Registry Act and the state constitutional amendment, which strips sex offenders of rights under the state constitution. The complaint raises claims regarding the rights to privacy, equal protection and to be free from retroactive punishment. After the Appellate Division dismissed the case, plaintiffs appealed, but the New Jersey Supreme Court declined to hear the case.
