Right to a speedy trial.
On February 29, 2012 the American Civil Liberties Union of New Jersey filed an Amicus Brief which argued that the New Jersey Supreme Court should clearly define the length of time that would allow for a denial of the right to speedy trial. Any violation of the 60 day limit that was set by the New Jersey Supreme Court in 1984 should shift the burden of proving that there was a reason for not going to trial earlier from the defendant to the state.
Status: This case is awaiting argument before the New Jersey Supreme Court.
