State v. Hinton

The ACLU-NJ filed amicus briefs in this case regarding whether it was constitutional for police to conduct a warrantless search of an apartment and seize property during eviction proceedings.  The briefs argue that (1) after receiving a report of contraband, the police were required to obtain a warrant to search the premises and (2) that, assuming the police did not need a warrant to search, they did need a warrant to seize the property.
