State v. Steele

In August 2013, the American Civil Liberties Union of New Jersey submitted an amicus brief on behalf of defendant Tyrone Steele to illuminate the problems with our state’s current system of pre-trial detention and release which relies on the resources a defendant has rather than determinations of risk. It unfairly penalizes poor people, who are more likely to be jailed as they await trial only because they cannot afford bail. The brief points to other jurisdictions in the country which have dramatically reduced reliance on money bails without compromising public safety. The brief requests the Supreme Court of New Jersey to utilize its rule-making and supervisory authority to review and reform New Jersey’s bail system.
