The ACLU-NJ filed an amicus brief in support of a public records requester asserting that the public has a right to access police dashboard camera videos because the public's interest in viewing such footage outweighs the government's interest in withholding it.

On August 13, 2018, a divided New Jersey Supreme Court held that the recording could properly be withheld on the Open Public Records Act. The dissenting Justices noted that the decision undermined transparency in an area where it is most needed.
