Amicus brief arguing that the Supreme Court of New Jersey retains the authority to review the constitutionality of the Council on Local Mandate’s decisions.

This case, pending before the New Jersey Supreme Court, concerns the interplay between the Council on Local Mandate and state courts. In this case, the COLM declared a statute that required municipalities to install dashboard cameras, mobile video recording systems, in newly acquired police vehicles as an unfunded mandate and then invalidated a $25 statutory surcharge against individuals convicted of driving while intoxicated to fund the program. The amicus brief, drafted in partnership with Lowenstein Sandler, argues that there is necessarily judicial review available to determine whether a particular dispute is justiciable and to review the constitutionality of the Council’s actions.
